Download claim against the Dutch State
Le Poole Bekema has initiated proceedings against the Dutch State on behalf of the Dutch film and television producers. For years the State argued that illegal downloading was legally permitted as the producers receive a so-called “private copying levy”.
In 2014 the European Court of Justice ruled that the private copying levy does not cover illegal downloading. The Dutch producers have suffered significant damages as a result of the misconception that downloading from illegal sources was permissible. The producers therefore intend to claim compensation for those damages from the State.
