Intellectual Property

Laura Broers represents Ryanair in proceedings concerning database law. The website Wegolo used flight details from Ryanair’s website for its own commercial purposes. In this litigation the European Court of Justice answered preliminary questions regarding contractual limitations to the use by third parties of a database, when the database does not enjoy protection on the basis of the 96/9 Directive. The preliminary questions were answered in favour of Ryanair, whereafter the Dutch Supreme Court referred the proceedings back to the Court of Appeal in the Hague.


Media

Bas Le Poole successfully represented the Japanese multinational Terumo, manufacturer of injection needles and catheters, in proceedings against the Dutch broadcaster AVROTROS. AVROTROS made accusations against Terumo in several broadcasts of EenVandaag. In its verdict of 3 August 2016, the Court ruled that the accusations were unlawful and ordered AVROTROS to publish rectifications on television and on its website. In addition, the Court ruled that AVROTROS is liable for the damages incurred by Terumo which are a result of the unlawful broadcasts.


Commercial Law

Maurice Joppe advised Canon Europe on, among other things, the insolvency of a contractual party. He has also advised Canon on the application of a commercial agreement.


Media

Laura Broers successfully represented Telegraaf Media Groep in proceedings against the European Commission concerning the release of confidential documentation in respect of an  unexpected additional assessment of € 642 million which the Netherlands was ordered to pay to the European Commission in 2014. Laura Broers and Bas Le Poole regularly represent the Dutch newspaper and website De Telegraaf in proceedings concerning publications.


Media

Bas Le Poole and Anne Bekema regularly represent the Dutch public broadcaster NOS in proceedings concerning, amongst others, the right to freedom of expression. Furthermore Bas Le Poole advises the NOS on a matter claiming damages in the Tarik Z. case. In 2015 Tarik Z., while armed, walked into the NOS headquarters and disturbed the prime time news.


Media

Bas Le Poole and Laura Broers regularly advise the Dutch broadcaster RTL on media issues and copyright. Among other things, Bas and Laura represented RTL in proceedings against The Einstein Grammar School which demanded a ban on the screening by RTL of an episode of the Project P programme on bullying. The episode contained images of pupils in and around the school, which were recorded by a hidden camera. The Court had to weigh the right to protection of the privacy of pupils against RTL’s right to freedom of speech.
